Who you are contracting with

Chap.AI is operated by Elliott James Chapman (Individual / Sole Trader) trading as Chap.Club, ABN 57 434 518 597, based in Queensland, Australia. Chap.Club is a registered business name, not a company: the responsible legal entity is Elliott James Chapman, an individual / sole trader. The address for legal notices is legal@chap.club; a postal address for service is available on request. By creating an account you agree to these Terms, the Privacy Policy, the Acceptable Use & AI notice, the Subscription & Billing Terms and the ChapPacks & Rewards Disclosure.

The service

Chap is an AI companion that chats with you, may remember some of what you choose to share, analyses and generates images, shows market data, creates small games and runs in-chat effects. Replies and images are generated by AI and can be wrong. Chap is not financial, legal, medical or mental-health advice, and market information is for general interest only.

AI output can be wrong

Everything Chap says, draws, generates or analyses is produced by artificial intelligence and may be inaccurate, incomplete, out of date or entirely invented. Chap never instructs you to take an action — anything that reads like a suggestion is an opinion or general information only, and the decision and its consequences are always yours. Do not rely on Chap for financial, legal, medical, mental-health, safety or other professional matters; consult a licensed professional instead. In an emergency, contact your local emergency services.

Generated pictures and games are temporary

Pictures Chap generates and games Chap builds for you are stored for 7 days from the moment they are created, then deleted automatically along with the stored file. You can also delete any of them sooner using the “Delete now” control shown under the picture or game. Deletion is immediate and permanent: once removed, the picture or game cannot be recovered by you or by us, and any link to it stops working. If you want to keep something, download it before the 7 days are up. Your ordinary chat messages and your memories are not removed by this rule.

Memory is not guaranteed

Chap’s memory is a convenience feature, not a record-keeping service. Memory is only kept when you switch it on, it holds a limited number of short notes, and once it fills up the least-used notes fade automatically so newer ones fit. Memories can also be changed, summarised incorrectly, lost through a technical fault, or removed when you delete them, clear your conversation or delete your account. Memory is separate from the 7-day rule for generated pictures and games: it is not on that timer, and it is equally not guaranteed to last.

We do not promise that anything you tell Chap will be remembered, remembered accurately, or remembered for any length of time. Never rely on Chap as the only place something important is stored, and never rely on it to remember safety-critical information — allergies, medical conditions, medication, emergency contacts, financial details, passwords, legal deadlines or similar. Keep your own record of anything that matters, and expect Chap to ask you to confirm such details again rather than assume them.

Markets information and data accuracy

The markets section — including price lists, best/worst performers, chart analysis from “Ask Chap”, and the chart trainer lessons — is general information and education only. It is not financial product advice, not a recommendation to buy, sell or hold anything, and it does not take your objectives or circumstances into account. Any “illustrative scenario”, entry, stop or target shown is a teaching example, not a recommendation.

Prices, charts and candles come from third-party data providers. They can be delayed, incomplete, wrong or unavailable — for example if your internet connection is poor or offline, if a provider rate-limits us or its servers go down, or if we fall back to cached or alternate-provider data. We do not guarantee the accuracy, timeliness or availability of any market data, and you should verify prices with an exchange before acting on anything. Crypto assets are highly volatile and you can lose the entire amount you put in. Always do your own research and consider licensed advice before making any financial decision. Chap.AI is information and education only: we do not execute trades, we do not buy, sell or exchange crypto on your behalf, and we never hold, transmit or have access to your funds, wallets or exchange accounts.

Your account

You need an account to use Chap. Keep your sign-in details secure and let us know if you think someone else has access. You must be at least 16 years old to use Chap.AI. After signing in you are asked to confirm your age bracket; we check this on our servers and accounts indicating an age under 16 cannot use the app. Giving a false age is a breach of these Terms.

Free plan and daily quotas

• 20 Chap replies per day, reset daily in your own timezone.
• 2 image uploads for analysis per day.
• Image Generation is Premium-only; free users can unlock it through ChapPack rewards.
• 1 game creation per day, from Chap's supported 2D game catalogue.
• 3 Ask Chap Market Analyses per day. This is a separate allowance from chat replies and is only spent on a completed market analysis.
• 1 free ChapPack per day.
• Only successful results count against a quota — if a reply, image or game fails, it is refunded automatically.

Premium

• Premium is A$24.99 AUD per month or A$229.99 AUD per year. Full details are in the Subscription & Billing Terms.
• Premium is not literally unlimited. It includes generous everyday chat subject to fair-use limits — a daily burst ceiling and a monthly fair-use level, both shown in the app with advance usage warnings and their reset timing, and enforced automatically. Daily limits reset in your account timezone; monthly fair use resets at the start of each UTC month. Premium also includes 20 image Photo Uploads and 3 Image Generations per day, Chap Vision multi-image analysis, 5 game creations per day including Chap's Premium 3D game catalogue, 9 Ask Chap Market Analyses per day, 3 free ChapPacks per day, candlestick charts and the full history range, premium models, faster replies and a 100% ad-free experience.

• Premium renews automatically at the price and billing period you chose, until you cancel. Monthly plans renew monthly and yearly plans renew yearly, on the same calendar day where possible. We tell you before a price change affects a renewal.
• New accounts may be offered a 3-day free trial, once per account. Unless you cancel before the trial ends, it converts into a paid subscription automatically at the price above. Cancelling during the trial keeps your access until the trial period finishes.
• You can cancel at any time from the Plan page in the app. Cancelling stops the next charge; your Premium access continues until the end of the period you have already paid for and then expires, and no partial-period refund is given for time already used.
• Purchases made inside the iOS or Android app are billed by Apple or Google and must be cancelled in your Apple or Google account subscription settings — cancelling there is the only way to stop store billing.
• If you reinstall the app or sign in on a new device, use Restore purchases on the Plan page. It re-checks your subscription with the App Store or Google Play and restores the entitlement that store says you currently hold.
• Upgrades from monthly to yearly take effect immediately and are prorated by the payment provider. Downgrades from yearly to monthly take effect at the end of the period you have already paid for.
• If a payment fails, your Premium access continues for a short grace period while the payment is retried. If it still fails, the account returns to the free plan and any unused pack balances remain on the account.

Credit and consumable packs

Packs are one-off purchases that top up a balance: extra messages, extra image uploads, extra Image Generations, extra Game Generations or extra Market Analyses. They are used automatically once the matching daily allowance runs out. Market Analyses are an exception in one respect: the daily Ask Chap Market Analysis limit (3 free, 9 Premium) still applies, so purchased Market Analyses do not raise or bypass it and instead remain in your inventory until the allowance resets. Packs do not expire while your account is active, are not transferable and have no cash value. Unused balances are lost when you delete your account.

Daily streaks, ChapPoints and ChapPacks

Signing in on consecutive days builds a daily streak. Each streak day offers one fixed, pre-published reward on a repeating ten-day cycle within a hundred-day season; reward sizes increase as the season progresses and the cycle then restarts while your lifetime streak keeps counting. Streak rewards are not randomised and are not a chance-based or paid mechanic. Premium subscribers receive a 3× multiplier on eligible streak rewards; apart from that Premium benefit, nothing about a streak can be purchased and no other purchase improves a streak reward. Eligibility is calculated from our server records of your account, not from your device clock, and each day's reward can be claimed once per account only — refreshing, signing out and back in, or using another device does not make it claimable again.

Missing a day ends the streak and it restarts at day one. Before that is final you may choose to spend 25 ChapPoints to continue the streak you lost. Recovery is always optional and never automatic: points are only deducted after you confirm, the offer applies to that one missed-day event, and it cannot be used twice for the same event. You can decline and start again at no cost.

ChapPoints, streak rewards, ChapPacks and other in-app allowances are promotional balances, not money, credit, tokens or property. They have no cash value, cannot be exchanged, redeemed, sold or transferred for money, and are usable only inside Chap.AI. They may be adjusted, withheld or reversed where we reasonably believe they were obtained through a fault, automation, clock manipulation, duplicate accounts or other abuse, and repeated abuse may result in suspension. Balances end when your account is deleted. We may change the reward cycle, reward amounts or the recovery cost at any time; changes apply to future days only and never remove a reward you have already claimed.

A ChapPack contains a collectible Chap card, which is cosmetic only, and may include small in-app allowances. Which card you receive is randomised. ChapPacks are not sold for money: you receive them free every day, from streak rewards, and by spending ChapPoints, which are themselves a loyalty bonus and are never sold on their own. Cards and packs cannot be traded, sold, cashed out or transferred, hold no value outside the app, and carry no prize, wagering or resale element. If a purchase ever entitles you to a pack, the possible contents are shown before you buy.

Sponsorships

Free accounts may see occasional sponsor cards inside the app. Sponsorships are sold by us directly; we do not use third-party advertising networks, and no personal information, conversation content or identifier is shared with a sponsor. A sponsor card is an advertisement, not a recommendation or endorsement by us or by Chap, and we are not responsible for a sponsor's products, services, claims or websites. Any dealings you have with a sponsor are between you and them.

Where an optional rewarded offer is available, viewing it may add a small number of extra messages to your account. Those extra messages are a courtesy with no cash value, are subject to daily limits, and may be withheld where we reasonably believe the offer is being gamed or automated. Premium accounts do not see sponsorships.

Prices, currency and taxes

All prices in Chap.AI are quoted in Australian dollars (AUD). Prices are in Australian dollars. Chap.Club is not currently registered for GST, so no GST is charged on purchases billed by us. Apple and Google convert and tax prices for your storefront, so the amount you are charged may differ. Prices may change; we will tell you before a change affects a renewal.

Billing and refunds

Web payments are processed by our payment provider, who acts as merchant of record and handles applicable taxes. Purchases made through the Apple App Store or Google Play are governed by that store's billing terms.

• Subscription periods already started are generally non-refundable, but we will consider a refund if you contact us within 48 hours of an unintended renewal.
• Consumable packs are refundable only if unused, or if a technical fault prevented them being delivered.
• Refunds for App Store or Google Play purchases must be requested from Apple or Google under their policies — we cannot refund a store purchase on their behalf.
• Nothing here limits your rights under the Australian Consumer Law or any other non-excludable consumer protections, including remedies where the service is not of acceptable quality.

Acceptable use

Your use of Chap, including image generation, is governed by the Acceptable Use & AI notice. Breaching it may result in blocked requests, suspension or account termination.

Your content

You keep ownership of what you write and upload, and of the images Chap generates for you, to the extent such rights exist. You grant us the limited permission needed to store, process and moderate that content in order to run the service. You are responsible for having the rights to anything you upload.

Copyright and intellectual-property complaints

If you believe content in Chap.AI infringes your copyright or other intellectual-property rights, email legal@chap.club with: your contact details; a description of the work and where the infringing material appears; a statement that you believe in good faith the use is not authorised; a statement that the information is accurate and that you are the rights holder or authorised to act for them; and your electronic signature. We remove or disable access to material that is the subject of a valid notice, notify the account involved, and may terminate repeat infringers. If your content was removed and you believe that was a mistake, you can send a counter-notice to the same address with the equivalent information.

Personal file storage (“My Files”)

A personal cloud storage area for pictures and documents is planned but is not available yet. Nothing you buy today includes it, no storage allowance is active, and we do not currently store files for you beyond the images you send to or receive from Chap in conversation. If it ships, its allowances and terms will be published before it is switched on.

Availability and liability

Chap is provided as-is. We do our best to keep it running but do not guarantee uninterrupted service, and third-party market, search or model providers may fail. To the extent permitted by law, our total liability is limited to the amount you paid us in the previous twelve months.

Ending the agreement

You can delete your account at any time from Settings, which cancels any active subscription billed through us and removes your data. We may suspend or end access for serious or repeated breaches of these Terms.

Governing law

These Terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. Mandatory consumer laws of your country of residence still apply.
